Donald Palmer was charged with the murders of Steven Vargo and Charles Sponhaltz on May 8, 1989 in Mt. Pleasant, OH. He was found guilty and sentenced to death on October 26, 1989.
During his clemency hearing in front of the Ohio Parole Board on August 16, Donald Palmer declined his interview for clemency, and instead submitted a written statement. His defense attorney affirmed this declination and submitted an affidavit for consideration.
In opposition of clemency, Assistant Attorney General Brian Deckert and Belmont County Prosecutor Chris Berhalter presented oral arguments. These arguments included the fact that the two victims were innocent victims and had families; that Donald Palmer had a history with drugs; and the connection between Palmer and the owner of the house that the incident took place in front of makes Palmer's location suspicious.
The parole board voted unanimously against clemency.
